Terms and Conditions of Messaging Services

Effective Date: September 27, 2025

These Terms and Conditions (“Terms”) govern your use of the messaging services provided by Five Star Plumbing (“we,” “us,” or “our”). By providing your phone number and opting in to receive text or SMS messages, you agree to these Terms, which are subject to applicable laws including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and relevant Texas laws.

Acceptance of Terms

By opting in to receive SMS communications from Five Star Plumbing, you consent to receive non-promotional, informational text messages to the phone number you provided. If you do not agree to these Terms, please do not use or opt into our SMS communications.

Scope of Messaging Services

Messages may include, but are not limited to:

  • Service appointment reminders and confirmations
  • Technician arrival updates
  • Account and billing information
  • Customer service follow-ups
  • Service satisfaction surveys

Marketing or promotional messages will not be sent unless you separately and explicitly opt-in for those communications.

Opt-In Consent

Under the TCPA, express written consent is required before sending non-emergency text messages using an auto-dialer. By opting in, you confirm you are the account holder or authorized user of the phone number provided and that you consent to receive messages from Five Star Plumbing.

Consent may be obtained via online forms, verbal agreement, or written documentation.

Message Frequency and Carrier Charges

Message frequency varies depending on service appointments and customer interactions.

Standard message and data rates may apply. We are not responsible for any charges imposed by your carrier as a result of our messages.

Opt-Out Process

You may opt out of the messaging service at any time by replying “STOP” to any message. Once opted out, you will receive one final message confirming the cancellation of future messages. You may also email us at fivestarplumbingcastroville.tx@gmail.com or call 210-673-0797 to request removal.

The messaging service is provided on an “as-is” and “as-available” basis.

User Responsibilities

  • Not abuse or misuse the messaging service
  • Inform us if your number is reassigned or deactivated

Misuse of the service, including harassing staff or triggering high message volume intentionally, may result in suspension or termination of access.

Termination or Suspension of Messaging Services

We may terminate or suspend your access to messaging services at our discretion and without notice, especially in cases of abuse, invalid contact data, or violation of these Terms.

You may also terminate participation at any time by following the opt-out instructions in Section 5.

Modifications to These Terms

We may revise these Terms from time to time. Material changes will be posted on our website, and continued use of the messaging service constitutes acceptance of the updated Terms.

Legal Compliance and Governing Law

These Terms are governed by the laws of the State of Texas and applicable federal laws including the TCPA, CAN-SPAM, and ECPA. Any disputes arising under these Terms will be resolved in the appropriate court within Medina County, Texas.

Entire Agreement

These Terms, together with our Privacy Policy, represent the entire agreement between you and Five Star Plumbing concerning SMS communications.
